Terms of Service
These terms apply when you use this website, book a table, place an order, buy a gift card or engage us for an event.
1. Who these terms are with
This website is operated by Maison Noir Hospitality LLC, a Delaware limited liability company with its principal place of business at 118 Hudson Street, Suite 2, New York, NY 10013. In these terms "we", "us" and "Maison Noir" mean that company, and "you" means the person using the site or buying from us. By using this site you accept these terms. If you do not accept them, please do not use the site.
2. Eligibility
You must be at least eighteen years old to make a reservation, place an order or buy a gift card. You must be at least twenty one years old to purchase alcohol, and we will ask for government issued photo identification at the restaurant regardless of appearance. This site is not directed at children under thirteen and they must not use it.
3. The website itself
We try to keep everything on this site accurate and current. Menus change daily and the dishes shown here are examples of our cooking rather than a promise of what will be served on a given night. Photographs are licensed stock images and do not depict specific Maison Noir dishes. Prices are correct at the time of publication and may change; the price that applies is the price shown at the point you book, order or pay. Where we make an obvious error, such as a menu item listed at a plainly wrong price, we may correct it and will tell you before taking payment.
You may not attempt to gain unauthorised access to the site, interfere with its operation, scrape it at a rate that degrades service for other people, or use it to send unsolicited commercial messages.
4. Reservations and deposits
Submitting the reservation form sends a request. A reservation exists only once we confirm it by email. Deposits are as follows and are credited in full against your final bill rather than charged in addition to it:
- Dining room: fifty dollars per guest.
- Chef's table: one hundred and fifty dollars per guest.
- Bar Noir and lounge: no deposit.
- Salle Noire private room: a one thousand dollar room deposit.
Cancel or amend more than forty eight hours before your seating and the deposit is released in full. Inside forty eight hours we retain the deposit for the seats we cannot resell. Chef's table deposits are non refundable inside seventy two hours because the kitchen buys specifically for those eight seats. Reducing a party size inside forty eight hours retains the deposit on the removed seats. We hold your table for twenty minutes past the seating time, after which the kitchen may serve a shortened menu at the full price.
A twenty percent service charge is added to parties of six or more and is shown on your check. It is distributed in full to the kitchen and service teams. Sales tax is added at the applicable local rate.
5. Online orders
Submitting the order form sends a request. We call or text to confirm the window and to take payment, and the order is accepted at that point. If we cannot fulfil an item we will tell you before taking payment and you may cancel without charge.
Because prepared food is perishable, orders cannot be cancelled once preparation has started. If something is wrong with your order, tell us within twenty four hours and we will replace it or refund it. Our own delivery charge is six dollars and ninety five cents, waived on orders over eighty five dollars within three miles. There is no service fee, packaging fee, small order fee or card surcharge on a first party order.
Orders placed through DoorDash, Uber Eats or Caviar are governed by that platform's terms as well as these, and their menu prices are higher than ours because they charge us a commission.
6. Gift cards
Gift cards are available from fifty to two thousand dollars. They do not expire, the balance does not reduce over time, and there is no activation fee, dormancy fee or reissue fee. They are redeemable at all three restaurants, at Bar Noir, against Noir at Home orders placed on this site, and in the Noir Pantry. They are not redeemable on third party delivery platforms.
Gift cards are not reloadable and cannot be exchanged for cash except where state law requires it, which we will honour on request. Unused cards may be refunded in full to the original payment method within thirty days of purchase. Lost or destroyed cards are replaced free of charge if you can give us the original order number. We are not responsible for gift cards bought from anyone other than us, and cards obtained through unauthorised resale may be voided.
7. The Cellar Club
Membership is free and voluntary. You earn one point per dollar spent on food and beverage at our restaurants, on first party online orders and in the Pantry. Two hundred and fifty points converts to a twenty five dollar credit. Points have no cash value, cannot be sold or transferred, and are forfeited if an account is inactive for twenty four months. Third party delivery orders do not earn points because those platforms do not pass us the information needed to credit them. We may change the earn or redemption rate with thirty days notice by email, and existing unredeemed points will be honoured at the old rate for those thirty days.
8. Events and catering
Events are governed by a separate written agreement that we issue after your enquiry and that prevails over these terms where the two conflict. In summary: the room deposit is refundable up to fourteen days before the date, final guest numbers are due seven days before and are the minimum you will be charged for, a twenty two percent service charge applies to the final bill, and off site charges for staffing, travel and equipment are quoted in writing before you commit. We will never add a charge to an event invoice that was not on the signed quote.
9. Allergies and dietary requirements
We will do our best to cook around any allergy you tell us about, and we would rather cook a different dish than remove an ingredient. However, our kitchens handle gluten, dairy, egg, soy, sesame, peanuts, tree nuts, fish, shellfish and mustard every service, and we cannot guarantee that any dish is free from traces of an allergen. Please read the allergen and nutrition disclaimer, which forms part of these terms. You are responsible for telling us about every allergy before you order.
10. Intellectual property
The Maison Noir name, the wordmark, the text of this site, the menus and the Journal articles are our property or are licensed to us. You may read, print and share pages for your own non commercial use. You may not republish our text or menus commercially, present our content as your own, or use our name or wordmark in a way that suggests we endorse you. Photographs on this site are licensed stock images and are not ours to sublicense.
11. Advertising on this site
Some pages carry clearly labelled third party advertising. Advertisements are chosen by ad networks rather than by us, and their presence is not an endorsement. We do not publish affiliate links. If we ever do, they will be disclosed at the point of use in compliance with Federal Trade Commission guidance, and this section will be updated to say so.
12. Disclaimers
This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non infringement in relation to the website. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law. Nutrition and allergen information on this site is provided for general guidance and is not medical advice.
13. Limitation of liability
To the extent permitted by law, our total liability arising from your use of this website or from any single transaction is limited to the amount you paid us for that transaction. We are not liable for indirect or consequential losses, including lost profits or lost enjoyment, arising from a website fault or a cancelled booking. This does not affect your statutory rights as a consumer.
14. Indemnity
You agree to indemnify us against claims arising from your misuse of this website or your breach of these terms, limited to claims caused by your own acts or omissions.
15. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Before starting formal proceedings, please write to [email protected] and give us thirty days to resolve the matter, because almost everything can be settled that way. If it cannot, the state and federal courts sitting in New York County, New York have exclusive jurisdiction. There is no mandatory arbitration clause in these terms and you do not waive your right to a jury trial or to participate in a class action.
16. Changes to these terms
We may update these terms and will change the date at the top of the page when we do. The terms that apply to a booking or order are the ones published when you made it. Continuing to use the site after a change means you accept the updated terms.
